According to POLITICO, a U.S. federal court judge in Texas, Mark Pittman, rejected OpenAI's motion yesterday local time, stating that Apple does not need to disclose the confidential antitrust settlement agreement it reached with SpaceXAI.

In his ruling, the judge stated that although there have been precedents for disclosing confidential settlement agreements, this was under the condition that they included information related to specific issues being litigated—the court, after a closed hearing, found that the settlement agreement between SpaceXAI and Apple did not contain information related to the disputed issues in the SpaceXAI and OpenAI lawsuits.

According to previous reports, X and SpaceXAI submitted a motion earlier this week to voluntarily withdraw their antitrust allegations against Apple last year, while stating that they did not seek to dismiss the allegations against OpenAI. OpenAI then filed an emergency motion asking the court to force disclosure of the settlement agreement between the two parties, which has now been denied.
