Recently, the State Administration for Market Regulation released five typical cases in the field of artificial intelligence, covering various illegal types such as counterfeiting, false advertising, and infringement of trade secrets, aiming to maintain a fair and competitive market order.

1. Deep "riding on the trend": DeepSeek imitations repeatedly penalized
In the announced cases, two companies were investigated for "riding on the popularity" of DeepSeek. Beijing Aolan De Information Technology and Hangzhou Bo Heng Cultural Media used unapproved similar or identical words, icons, and page designs to "DeepSeek" on their own websites to promote a software called "DeepSeek Local Deployment Tool" and induce payments. The regulatory authorities believed that this behavior misleads users by taking advantage of information barriers, seriously damaging the official brand image, and the two companies were fined 5,000 yuan and 30,000 yuan respectively.
2. Transnational "shell": ChatGPT Chinese version is not what it seems
Shanghai Qiyun Network Technology provided AI chat services through its public account "ChatGPT Online" and claimed to be the "Chinese version of ChatGPT". It was found that the company only used OpenAI's API interface, not the product itself, and the avatar design was highly similar to the official one. The regulatory authorities determined that the company deliberately created confusion, constituting unfair competition, and imposed a fine of 62,000 yuan according to law.
3. Algorithm as core: 15GB trade secret theft case
Trade secret protection in the era of artificial intelligence has become increasingly severe. An engineer at a computing company, Min Zhong, used his work key to secretly download 15.88GB of core technical files including data algorithms and big data code. The Hangzhou Market Supervision Bureau pointed out that algorithms are the core competitiveness of AI companies, and thus issued a huge fine of 360,000 yuan based on the Anti-Unfair Competition Law.
