Spain recently held a meeting on May 26 local time and approved the draft of the "Reasonable Use and Organization Law of Artificial Intelligence" proposed by the Ministry of Digital Transformation and Public Administration. This new bill aims to integrate the EU's "European AI Act" into Spain's legal system, promoting the safe use and innovation of artificial intelligence technology. The bill also clarifies the AI regulatory body in Spain and establishes relevant penalty mechanisms to encourage public sectors to be more proactive in using AI technology.
According to the draft, illegal acts will be divided into three categories: very serious, serious, and minor. Violations of very serious nature may face a maximum fine of 3500 euros or 7% of turnover as punishment; the upper limit for minor violations is 500,000 euros or 0.5% of turnover. This penalty system aims to strengthen the regulation of AI use to ensure the safety and compliance of the technology.
In addition, the draft proposes an administrative procedure list aimed at regulating the use of artificial intelligence and establishing a dedicated position for AI, responsible for supervising and managing related work. At the same time, the draft also plans to establish an AI testing sandbox, providing an experimental platform for enterprises and institutions to test and innovate with the technology.
This series of measures not only emphasizes the importance of regulation but also encourages all public sectors in Spain to introduce AI technology in their daily operations to improve efficiency and service quality. As the legislative process progresses, Spain is expected to become one of the pioneers in AI legislation in Europe, striving to protect user rights while promoting the development and application of the technology.
